WOODLAND — Clayton Garzon will remain in Yolo County Jail custody until his scheduled sentencing next week in a Davis hate-crime case, it was decided Thursday.

Defense attorney Linda Parisi made the request during a brief court hearing for Garzon, whose release on bail was revoked earlier this week as a result of several technical violations regarding his GPS monitoring system.

“We can address this issue at that time,” Parisi told Yolo Superior Court Commissioner Janene Beronio.

Garzon is scheduled to be sentenced Wednesday for his no-contest plea to felony battery and hate-crime charges, both stemming from the March 10 beating of a gay man, 32-year-old Lawrence “Mikey” Partida, near downtown Davis.

Yolo County probation officials, who have been supervising Garzon since his release on bail in March, say the 20-year-old had been a model client until about two weeks ago, when an apparent failure to charge his GPS battery as required caused a brief lapse during which probation was unable to track his whereabouts. It happened again on Monday, this time for about eight hours.

Those violations, plus changes in Garzon’s behavior that probation officials declined to elaborate on, prompted the change in his custody status.

Said Parisi: “He’s just been under a lot of stress, with everything that’s going on. Hopefully we’ll get it all resolved (next week).”
